Copyright (copyrights in the USA and UK) are a form of intellectual property that protects original works and allows their creators to generate income.

In addition, it provides its holders with (“rights holders”) the exclusive right to reproduce the work, create derivative works (modifications and alterations), distribute the work, perform the work, exhibit and disseminate the work.

In music, there are two main types of rights:

  1. those derived from the compositions (Publishing rights or Publishers)
  2. those originating from sound recordings (Recording Rights or Phonographic Rights)

The Composition includes the fundamental elements of music, such as melody (Music) and lyrics (Lyrics). It is often referred to as a ‘song’ (Song) or ‘music publishing’ (Publishing).

A Sound Recording: What is it? A specific recorded performance of a composition.

Royalties are payments obtained for the use and reproduction of a musical work (composition and/or recording). They include income from, among others:

  • Streaming (Spotify, Apple Music, Amazon Music, Youtube...)
  • Physical sales (vinyls, CDs...) and digital sales (downloads)
  • Public use and dissemination: TV, radio, bars and clubs, shopping centres, etc.
  • Live performances: Concerts and live festivals.
  • Synchronisation licences (e.g. use in video games, films, series or advertisements).
